Terms & Conditions of Service

These Terms & Conditions apply to EleosForms, a hosted Forms Manager service provided by Avada Services Pty Ltd T/A Eleos Business Services, ABN 89 630 298 047. By creating a trial, accessing a portal, or using the service, you agree to these terms on behalf of the business or organisation you represent.

1. The Service

EleosForms provides hosted wizard-style forms, form templates, user and group management, public form links, submissions, PDF generation, media storage, signature capture, AI-assisted features, and related subscription management tools. Features may vary by package, storage allowance, support level, and integration access.

2. Business Use

EleosForms is supplied for business and organisational use. You are responsible for ensuring the information you collect, the forms you publish, and your use of submissions complies with the laws, regulations, industry rules, and privacy obligations that apply to your business.

3. Accounts and Security

You must provide accurate account, organisation, contact, domain, and billing information. Subscription management users must keep login details secure and complete two-factor authentication where required. You are responsible for activity performed through your account or portal.

4. Trial, Subscriptions, and Taxes

Unless stated otherwise, new subscriptions begin with a 30-day free trial and no credit card is required to start. Before paid service begins, an owner or billing contact must activate the selected package through EleosForms subscription management. Prices are listed in USD and exclude GST, VAT, sales tax, or similar regional taxes. Applicable taxes are calculated during secure Stripe activation where required. If a trial is not activated, we may restrict portal access or begin the cancellation and data-retention process after reasonable notice.

5. Payment Processing

Subscription activation, payments, invoices, payment-method handling, and billing portal functions are processed by Stripe. EleosForms does not store raw credit card numbers or CVV codes. Completing activation authorises recurring subscription charges according to the package and billing period shown during activation or later changed through subscription management. No subscription charge is authorised merely by starting a no-card trial.

6. Price Changes

We may change package prices, package names, storage allowances, feature inclusions, billing periods, or available plans from time to time. If a price increase applies to an existing paid subscription, we will give advance notice before the increase takes effect. Monthly subscriptions will not be increased during the current monthly billing period. Annual subscriptions will keep the paid annual price until the next annual renewal date.

If you do not agree to a notified price increase, you may cancel your subscription before the increased price applies. Cancellation rights, access after cancellation, and refund handling are described in the Refund & Cancellation Policy. Changes to GST, VAT, sales tax, foreign exchange handling, payment processor fees, or other taxes and charges required by law or payment providers may be applied separately from package price changes.

If you create a trial, the package price shown at signup applies to the first paid billing period after the trial unless you change package, change billing period, accept a different offer, or we notify you of a change and give you the option to cancel before billing begins.

7. Customer Content and Data

You retain ownership of the forms, files, branding, submissions, and other content you upload or collect through your portal. You grant EleosForms the rights needed to host, process, transmit, secure, back up, and display that content for the purpose of providing the service.

8. AI-Assisted Features

AI-assisted features may help draft forms, support text, or responses. You remain responsible for reviewing generated content before publishing or relying on it. Do not submit sensitive information to AI features unless you are satisfied you have authority to do so and it is appropriate for your use case.

9. Acceptable Use

You must not use EleosForms for unlawful, harmful, deceptive, infringing, abusive, or high-risk activity. You must not attempt to bypass security controls, overload the service, distribute malware, collect information without proper authority, or use the service in a way that would breach payment processor requirements or applicable restricted-business rules.

10. Domains and Email

You are responsible for controlling any custom domain you connect to EleosForms and for maintaining correct DNS records. If you configure your own domain for email sending, you are responsible for SPF, DKIM, DMARC, and related records. We may suspend custom-domain or mail features if configuration issues create security, deliverability, or abuse risks.

11. Availability and Changes

We aim to provide a reliable hosted service, but we do not guarantee uninterrupted or error-free operation. We may update, improve, limit, suspend, or discontinue parts of the service where reasonably needed for security, maintenance, compliance, or product development.

12. Support

Support is provided through the contact options and support levels available for your package. Priority support and integration assistance may be limited to specific packages.

13. Cancellation and Termination

You may cancel your subscription as described in the Refund & Cancellation Policy. We may suspend or terminate access if you breach these terms, fail to pay, create security or abuse risk, or use the service in a way we cannot lawfully or commercially support.

14. Liability

To the maximum extent permitted by law, EleosForms is provided without warranties beyond those that cannot be excluded by law. We are not liable for indirect, consequential, special, or lost-profit damages. Nothing in these terms excludes rights that cannot be excluded under the Australian Consumer Law or other applicable laws.

15. Governing Law

These terms are governed by the laws of Western Australia, Australia. The parties submit to the courts of Western Australia for disputes connected with these terms, subject to any mandatory law that applies in your location.
